It would have made more sense if TTC will be analyzing the results of the direct-hit search or providing you with an opinion as to whether your trademark is even eligible for registration, but that’s not the case.
It’s also worth mentioning that a direct-hit search and a comprehensive federal trademark search aren’t the same. The former won’t reveal “confusingly similar” marks that could prevent the successful registration of your trademark.
Also, there are many categories of trademarks that are legally ineligible for registration under any circumstances. Unfortunately, The Trademark Company can’t tell you if your mark falls under this because they don’t work with trademark attorneys.
Preparation and Filing of the Trademark Application
Secondly, despite what is stated on its website, The Trademark Company is not preparing your trademark application.
Instead, you are preparing your own application by filling out The Trademark Company’s online questionnaire, which simply mimics the official USPTO trademark application form, and then submitting it to The Trademark Company.
By paying The Trademark Company $199, all they are doing is copying and pasting your answers from the questionnaire onto the USPTO application form, and hope that your application gets approved.
